The motion passed with a unanimous vote. SCHEDULED ITEMS 13. ORDINANCES/PUBLIC HEARINGS 13.A. ORDINANCE/PUBLIC HEARING – An Ordinance of Eagle Mountain City, Utah, Adopting the Eagle Mountain City Fiscal Year 2021-2022 Budget. *This is not an action item; public hearing only. Finance Director Kimberly Ruesch presented the item. A summary of the tentative budget was presented to the City Council at the May 04, 2021 meeting totaling $44,778,219. A budget workshop was held on May 27, 2021 to discuss the budget and capital projects that would be included in the budget. The items discussed during the workshop and this meeting will be added to the tentative budget and be available for review by the public by June 5, 2021, in preparation for the final public hearing on June 15, 2021. Mayor Westmoreland opened the public hearing at 7:56 p.m. No comments were submitted to the City Recorder’s Office and no public was in attendance to make comment. As there were no comments, Mayor Westmoreland closed the hearing. 13.B. ORDINANCE/PUBLIC HEARING – An Ordinance of Eagle Mountain City, Utah, Approving an Amendment to the Eagle Mountain Municipal Code Chapter 16.35 Development Standards for Required Public Facilities. Mr. Jensen reviewed the item as presented during work session. The location of the mailbox pullout will be approved during the preliminary plat and site plan phase of new developments. Assistant City Administrator/Community Development Director Steve Mumford said the City will approve the location prior to a development receiving approval from the United States Postal Service (USPS). Should USPS not approve the proposed location, the development applicant can request an amendment to relocate the mailbox. Councilmember Curtis recommended allowing staff to approve amended plans if the USPS does not approve proposed locations. He expressed concern with the quarter-mile distance of the mailboxes from the unit served requirement as potentially problematic for developments with large lots. Mr. Jensen clarified the mailbox placement is proposed to be a staff-level approval by the Community Development Director. Councilmember Love concurred with Councilmember Curtis and recommended adding “when possible” to Section 16.35.150(B) “All homes shall be located within one-quarter of a mile (¼ mile) (1,320 Feet), measured along normal walking paths/routes.” Councilmember Clark reiterated her concerns discussed during the previous work session regarding the repair and replacement responsibility for the mailboxes. Discussion ensued evaluating a potential future amendment to create a mechanism for a mailbox repair and replacement fund should the burden fall to the City. Councilmember Love said the USPS website directs individuals to contact the local post office if a USPS-owned and maintained mailbox is damaged or broken. Accordingly, she requested staff contact USPS to determine responsibility for the mailboxes before the Council considers the creation of a mailbox maintenance fund. She expressed her support of the functionality and safety improvements of the amendment. Councilmember Gray moved to approve a resolution of Eagle Mountain City, Utah approving a master development agreement for Scarlet Ridge Estates. Councilmember Clark seconded the motion. Those voting aye: Donna Burnham, Melissa Clark, Colby Curtis, Jared Gray, and Carolyn Love. The motion passed with a unanimous vote.

Councilmember Gray moved to approve a resolution of Eagle Mountain City, Utah approving the first amendment to the Interlocal Cooperation Agreement between the Eagle Mountain Redevelopment Agency and Eagle Mountain City for the collection and remittance of incremental property taxes collected from the property within the Sweetwater Industrial Park Community Reinvestment Area #2. Councilmember Burnham seconded the motion. Those voting aye: Donna Burnham, Melissa Clark, Colby Curtis, Jared Gray, and Carolyn Love. The motion passed with a unanimous vote. 15. CITY COUNCIL/MAYOR'S BUSINESS None. 16. CITY COUNCIL BOARD LIAISON REPORTS Councilmember Love Councilmember Love thanked everyone again for the Memorial Day program. The addition of a statue representing a WWII soldier personally touching to her as a remembrance of servicemen in her family that served during WWII. She reminded the Council of the upcoming luncheon with Governor Cox on June 10, 2021. Councilmember Clark Councilmember Clark said that Be Ready Eagle Mountain will hold a swim safety class on June 10, 2021. Additional information regarding upcoming classes is available on the City website. A Ham radio exam will be held on June 19, 2021, and the repeater installation is ongoing. The preliminary plan for the Smith Ranch Park addition will be available for viewing at a booth at Nolan Park during Pony Express Days. She appreciates the innovative combination of a nature and neighborhood park in the park plan. She requested an update regarding the wash disturbance issues. City Engineer Chris Trusty said he has the State permit and is waiting on supporting materials and drawings from the development’s engineer. Work has been halted until the approvals come through. Mayor Westmoreland confirmed that staff is working on Councilmember Clark’s request for a wash protection amendment. Councilmember Gray Councilmember Gray said that Eagle Mountain Arts Alliance events will take place throughout the summer. The Youth Council appointments for the upcoming term will be forthcoming.
