ORDINANCE - An Ordinance of Eagle Mountain City, Uøh, Amending the Eagle Mountain Municipal Code, Chapter 17.80.080 Off-premises Ladder Signs. Economic Development Director Aaron Sanborn explained the ladder signs in the City were previously managed by the Lehi Area Chamber of Commerce. The program is now being administered by the City until the Eagle Mountain City Chamber of Commerce begins management. He said the current Municipal Code is sparse in details regarding program administration. This updated Code will set a priority list for entities advertising on the ladder signs, giving priority to local commercial and home-based businesses. It also adds language to create an application process. Approved maps specify locations where signs can be added. The sign locations are at least 1,000 feet apart, except in specific locations with high traffic and commercial uses. Signs that pose traffic hazards will be moved. New signs will only be added when all existing sign space is in use. Mr. Sanborn said items for the Council to consider include a potential limitation to the number of signs an entity can lease, a process in which an entity can use to install a sign in a location not on the approved sign location maps, and where the applications will be submitted. Applications can be submitted to the Economic Development Director, or to the Eagle Mountain Chamber of Commerce, if an agreement is in place. Councilmember Reaves asked how staff will determine what signs need to be moved for safety reasons. Mr. Sanborn said there is only one sign that poses a safety concern; this is located at Pony Express Parkway and Porters Crossing. He said it is too close to the intersection and will be moved" A standard can be in place to determine how far signs must be from intersections and from residences. Councilmember Clark asked why a sign location was included on Porters Crossing, far south of Pony Express Parkway. Mr. Sanborn explained that is a commercial area. Councilmember Clark stated the Dconomic Development Director will accept applications until the agreement is in place. Councilmember Burnham requested the agreement return to the Council for approval. Councilmember Curtis agreed to remove condition number four from his motion.

Eagle Mountain City Council Meeting - June 18, 2019 Page ll of14 Assistant City AdministratorÆinance Director Paul Jerome explained this is the final budget amendment for the current fiscal year. One change is regarding the utility rate study. This study may continue into the next fiscal year, requiring an amendment to that year's budget. Two of the amendments affect the Impact Fee Funds. The reimbursement to SITLA is due to the City's growth. The inøease to the Aviator Road widening project is impact-fee eligible. ORDINANCE - An Ordinance of Eagle Mountain City, lJtah, Adopting the Eagle 'Iax Mountain City Fiscal Year 2019^2020 Budget and Certified Rate" Mr. Jerome explained the following changes made to the budget since it was presented to the Council on May 21,2019. The City currently fully depreciates the value of City vehicles, and as they are purchased at a discount on the State contract, the additional value retained at the sale of the vehicles will now return to the assigned department's budget. Additional increases in the General Fund expenditures are due to the purchase of a vehicle for a new inspector, $40,000 for phase two of the Utah State University water conservation program, $60,000 for Capital Projects, and $18,500 for records management software. The decrease in the General Fund expenditures is due to a change in staffing in the Finance Department. Mr. Jerome explained the Enterprise Fund changes include the increase in revenue due to the sale of vehicles. The Capital Projects Fund now includes all projects on the Council's priority list. Councilmember Curtis expressed concern that the amendment will deplete the Capital Projects Fund. Mr. Jerome explained the purpose of this fund is to complete capital projects; the Fund Reserve, which is at 24o/o, is what is used in case of emergency. If funds in the Capital Projects Fund are needed for emergency uses, a public hearing must be held to transfer those funds. If the Fund Reserve reaches the maximum allowed limit of 25yo, all additional revenue must be placed in the Capital Projects Fund" Mayor W'estmoreland opened the public hearing at 7:59 p.m. As there were no comments, he closed the hearing.

RESOT,UTION * A Rosolution of Eagle Mountain City, Utah, Approving the Eagle I{eights Village Master Development Agreement. Planner Tayler Jensen explained on May 21, the Council approved a master development plan for this project. The approval is oontingent upon approval of a master development agreement. Councilmember Clark asked City Attorney Jeremy Cook if the Council's motion needs to include changes discussed during work session. Mr. Cook said the two changes are a change in the developer's entity name and a change to section 2.4 regañing the trail. The second sentence should state the developer shall use commercially reasonable efforts to obtain an easement for the trail. Councilmember Clark's requested change requiring the trail around the detention area to be asphalt was noted during work session, as well. He said this master development agreement is very simple as the plan is mostly set, unlike other master development agreements. Councilmember Curtis stated he did not agree with the master development plan, but as that has been approved and this master development agreement matches the approved plan, he will vote in favor of the agreement.
